We welcome you to Highland Cinema in Fort William and hope you have an enjoyable visit. By visiting our website/app and/or buying tickets through our website, app, or any third-party applications over which Highland Cinema has control, you agree to be bound by the following Terms and Conditions.

Highland Cinema is the trading name of Highland Community Cinema Trust, a registered charity in Scotland (SC054602), and Highland Cinema Trading Limited, a company registered in Scotland (SC870453).

1. WHO WE ARE

1.1. “Us”, “We” or “Highland Cinema” means Highland Community Cinema Trust, a registered charity in Scotland (SC054602), and Highland Cinema Trading Limited, a company registered in Scotland (SC870453).

1.2. “Indy” means Indy Cinema Group, our provider of Point of Sale (POS) and film schedule technology we use to process ticket sales, memberships and other customer transactions.

1.3. “You” means everyone who purchases a ticket and everyone who visits Highland Cinema.

2. GENERAL

2.1. Highland Cinema visitors / customers are responsible for their own belongings at all times in all parts of our building.

2.2. No smoking (including e-cigarettes) is allowed anywhere on the premises, apart from on the terrace.

2.3. Dry, well behaved dogs are welcome on the terrace and in the restaurant bar with the agreement of the duty manager. Should they cause disturbance to other customers, the owner may be asked to leave with their animal.

2.4. Only food and drink purchased within the building may be consumed within the restaurant bar and cinema.

2.5. Hot food is not permitted in the cinema screens.

2.6. Anti social behaviour either within the restaurant bar or cinema screens will result in the individual(s) being asked to leave. No refunds will be given in these instances. Repeated violations will result in a long-term ban.

2.7. Anyone caught trying to enter a screen without a valid ticket, or moving between screens during showings, will be immediately asked to leave. No refunds will be given in these instances. Repeated violations will result in a long-term ban.

2.8. The use of recording devices in the auditoriums is an illegal activity. If you are caught attempting to record any part of a film you will be stopped and the police called. No refunds will be given in these instances.

2.9. Before entering either cinema screen, you may be asked to submit to a bag search. Any refusal by you may result in refusal of admission or eviction from the cinema.

2.10. To avoid disturbing other customers, any latecomers may not be allowed to enter the auditorium.

2.11. All mobile devices must be turned off / kept on silent during a film.

2.12. Highland Cinema always tries to ensure that performances take place at the advertised programme time. However, we reserve the right to cancel or vary the times of a performance or substitute an alternative film, if this becomes necessary due to matters beyond our control.

2.13. If a performance is cancelled, rescheduled or substituted in accordance with paragraph 2.12. of these Terms and Conditions, the Duty Manager will have the decision to either:

2.13.1. refund you the cost of tickets already purchased; or

2.13.2. provide you with tickets for the same film at an alternative day/time. No refund shall be due to you in these instances.

2.14. Tickets will not be refunded due to adverse weather or travel conditions, if the performance goes ahead as advertised.

2.15. CCTV operates throughout Highland Cinema, including night vision in both screens. By purchasing tickets you consent to you and your party being included in any recording, and to its exploitation, without payment.

2.16. Highland Cinema occasionally acts as a box office for third-party events. These events are facilitated but not run by Highland Cinema and we take no responsibility for any aspect of their programme or operation. Any queries should be directed to the promoter concerned.

3. TICKET PURCHASE AND MEMBERSHIP

3.1. Tickets may be purchased both on and offline by registered and unregistered users. A register and login membership system is provided for regular visitors, to allow them to make faster bookings and record their cinema visit preferences.

3.2. Tickets may be purchased online, by phone or in person at Highland Cinema. Please check the name of the show, venue, date, time and price prior to purchase. It is your responsibility to select the correct show, time and age appropriate tickets, and no refund will be given due to an error in this regard.

3.3. By purchasing a ticket via our website, app, over the phone or in person at the Box Office, you are agreeing to our Terms and Conditions of sale. Where you are making a booking on behalf of a number of people, you accept these Terms and Conditions on behalf of all members of your party.

3.4. All tickets, price types and discounts are subject to availability, and can be changed and/or withdrawn without prior notice. No refund on pre-booked tickets will be made on the announcement of a subsequent special offer.

3.5. Gift vouchers cannot be used to buy tickets online, but may be used over the phone to reserve seats in a showing. Memberships can be used online and on the phone, under agreement of the ‘Membership Terms & Conditions’ stated at the time of Membership registration.

3.6. Where a concession is claimed, proof of identity and entitlement may be required. Please make your concession requirement known at point of sale. Concession types and availability may vary and cannot be added retrospectively. Reductions may be limited for certain events. On occasion, certain concessions may not be available online.

3.7. If you or any member of your party has support needs, please raise these when booking and we will endeavour to help you with your requirements. If you require a wheelchair space, please inform the Box Office at the point of booking.

3.8. To make a ticket booking by credit/debit card, the user must provide a card number, security code, expiry date, the card start date and/or issue number (where applicable) and their postcode. Highland Cinema does not store this information. All ticket booking, membership and other personal user information is stored on a secure internet system, hosted by Indy Cinema Group (Indy), more details of which can be found in section 6. 3.9. Ticket collection: Tickets can be collected at Highland Cinema, Cameron Square, Fort William PH33 6AJ. Proof of ID will be required when collecting pre-booked tickets. Where a credit or debit card has been used to purchase tickets online, please present this card at the time of collection.

3.10. Ticket refunds: We are under no obligation to amend or refund tickets once booked for any performance that goes ahead as advertised. Booking fees are never refunded.

3.11. In exceptional circumstances we may change tickets for alternative films / showtimes to those specified on the ticket.

3.12. Ticket types: The followings standard types of tickets are available for purchase:

Adult: age 15 and over;

Child: under 15;

Babies and children under 2 are admitted free if they are sitting on a parent / guardians knee. Any child of any age that requires their own seat requires a ticket. Those with small children are asked to be considerate of those around them and to ensure they stay quiet and seated during the performance.

CEA / Plus One card holder: Carers of disabled customers are entitled to receive a complimentary ticket if the person they are accompanying can show a valid CEA Card or Highland Council Plus One Card.

3.13. For the protection and the comfort of all customers, Highland Cinema reserves the right to refuse admission to any individual or party in reasonable circumstances, including for reasons of health and safety, licensing laws, or aggressive or abusive behaviour of the customer to our staff or to other customers.

4. AGE RESTRICTIONS

4.1. All films shown in UK cinemas must be rated by the British Board of Film Classification (BBFC). This rating is clearly shown on our website / app film listings, and it is the responsibility of the ticket purchaser to check any advertised restrictions before they purchase tickets.

4.2. Customers may be asked to provide photographic identification of proof of their age.

4.3. We will refuse admission to those unable to verify their age if asked.

4.4. Anyone may be admitted to films classified as U or PG.

4.5. Children under the age of 12 may be admitted to films classified as 12A but must be accompanied by an adult over the age of 18. At our discretion, we may allow the adult to stay in the restaurant / bar area during the film runtime.

4.6. Nobody under the age of 15 may be admitted to films classified 15.

4.7. Nobody under the age of 18 may be admitted to films classified 18.

5. LIABILITY

5.1. We accept no liability for any costs, claims, penalties, losses or damages arising from any failure to perform any of the obligations we have to you. To the extent which liability cannot be excluded, our liability is limited to the ticket price.

5.2. We do not limit our liability by law to you for death or personal injury caused by our negligence or breach of duty. Likewise we do not limit or exclude any statutory or other rights you may have as a consumer.

6. WEBSITE, BOOKING AND DATA PROCESSING

6.1. The content on our website / app is provided for general information only. It is not intended to amount to advice on which you should rely, and you must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our website / app. While we make reasonable efforts to keep the information on our website / app up to date, we make no warranty, representation or endorsement that the content on our site is accurate, complete or up to date. We reserve the right to correct any errors or omissions without notice and without liability to you.

6.2. Original content and materials on our website are protected by copyright and other intellectual property rights. If you wish to reproduce anything from our site, you must first seek permission.

6.3. Where our site contains hypertext links to external websites provided by third-parties, these hypertext links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources. It is a feature of cinema websites that much of the information on our site is contributed to us by different third parties and we do not control these parties or their information. This information and these materials have not been verified or approved by us.

6.4. Our film listings, booking, payment and membership systems are operated by Indy Cinema Group (Indy). When you provide your data through our website or app, the data will be processed through the Indy POS by Indy Cinema Group, but Highland Cinema remains in control of the data. Highland Cinema is the “data controller”, and Indy Cinema Group is our “data processor”.

6.5. Highland Cinema has signed a data processing agreement with Indy to govern how they handle your data, ensuring that they adhere to the terms of our policy and to any other relevant policies or instructions Highland Cinema may give them. Indy maintain strict GDPR compliance across their business and also maintain their own general privacy policy, which we encourage you to read.

6.6. By visiting our website / app and/or buying tickets through our website, app, or any third-party applications over which Highland Cinema has control, you also agree to be bound by our Privacy Policy.

7. CUSTOMER SERVICE

7.1. In the event that you find inaccurate information on our website or have a complaint about what we have published, please alert us by emailing info@highlandcinema.co.uk. We will investigate on receipt and take such action which we determine as being appropriate.

8. JURISDICTION

8.1. Please note that these Terms and Conditions, their subject matter and their formation, are governed by Scots Law. The Scottish Courts have exclusive jurisdiction to settle any dispute arising from these Terms and Conditions.
